2 Workers Die In Hastings-On-Hudson Explosion

Two workers lost their lives while working on what is believed to be a 500 gallon heating oil tank located and buried in the backyard of a home at 65 Hillside Avenue. An unknown quantity of gasoline was also found stored in the adjacent garage and of-loaded into a 55-gallon drum. The multi-family home is owned by Django Morrison. Apparently, the two workers were attempting to cut the tank so it could be removed from the ground and were unaware there was still product in it. As they cut into the metal tank with a saw, sparks from the saw must have ignited the vapors and product, causing the remaining product to explode. Unconfirmed reports believed they worked for Three D Maintenance Corporation of Elmsford.

The Hastings-On-Hudson Fire, Police, EMS and Highway Departments all responded to the scene. Other police agencies assisted including the Westchester County Hazardous Materials Response Team, OSHA, PESH, and others. At one point County Executive Rob Astorino stopped by to survey the aftermath at the scene. Once the explosion happened, witnesses stated the oil tank flew upwards about 75 feet into the air, landing in the woods behind the property some 50 or 60 feet from its original location. The workers bodies were thrown approximately 20 feet from where they had been working and are thought to have died instantly. Paramedics on scene performed CPR on both victims to no avail.

Several helicopters flew overhead filming the activity on the ground and other media representatives were in attendance as well. This tragic event, could have been avoided had proper safety precautions been observed and implemented before the removal process began. Our thoughts and prayers go out to the families of these workers.

5/8/2015 - Addendum: ABG has learned the identities of the two workers: Luis Jacho, 52, and Mora Segundo, 50, both residents of Ossining. We've since learned from unconfirmed sources that the outside oil tank had been used to store gasoline, probably either old gasoline or excess from different pieces of equipment. Modern gasoline additives cause gasoline to have a shelf life and can "gum-up" fuel lines if left to sit unused. Disposal of used or outdated gasoline is cumbersome and sometimes shortcuts are taken. Apparently, Mr Jacho and Mr Segundo were unaware of the tank having gasoline in it and its volatility. Had this tank been used as intended to store oil, the workers might have still created a hazardous condition by cutting the tank with product in it but the outcome might not have been fatal.

Indifference And Insensitivity

September 11, 2001. It’s known as the Second Day of Infamy. The cowardly murders perpetrated upon us under the guise of a few skewed religious zealots affected many, many lives, families, friends and acquaintances throughout our Town and our country. Many Towns and Villages had September 11th services to remember and honor those taken away from us so swiftly. There were numerous events during the day around the County. In fact the County had a service held during the day at the Kensico Dam Plaza’s The Rising Memorial Statue. While the County rarely does anything at the Dam in the evening when most people can attend (except fireworks), it was a nice tribute to those fallen Westchester residents, our relatives, friends and others.

Totaling ignoring the solemnity of the day and casually acting as though nothing happened was our Town Board. They held the regularly scheduled Town Board meeting, with nothing more than a moment of silence for those victims of the September 11th attacks hastily reminded by Mr Sheehan. This callous and even impenitent action for such a horrific event can only be rationalized with distain for this Board. This is the same Board that will shamelessly campaign at each Town Board meeting, cut residents off from speaking and do whatever they please without regard for legality or ethics. Obviously, their bad behavior is an effective strategy given the results of this past Democratic primary.

The meeting was attended by a few Hartsdale residents seeking more garbage cans in their “downtown” area and some plants near the train station. Several of these people engaged in conversations back and forth from their audience seats, never once being asked by the Board to go to the microphone as they so often do to members of the G10 or anyone else who is critical of them. Playing (?) dumb, Mr Feiner kept his microphone off so neither exchange could easily be heard. One of the G10 stalwarts, Mr Hal Samis was in attendance. When he went to the podium, he asked a number of questions. In a surprising turnaround, Mr Feiner answered several until Mr Samis re-asked questions that were not answered. After not being satisfied and pushing back for answers, Mr Samis was finally told they would answer his questions once he sat down. This is a perfect example of the duplicity of our Town Board. They’re back.

For Mr Feiner to say that he wants people to talk to him so he can address why they didn’t vote for him in the recent Democratic primary election, to engage new or dare we say unobtrusive residents with minor issues and then to put off someone else during the same exchange highlights just one of the glaring problems found in our Town government. Perhaps if Mr Samis had asked for another garbage receptacle anywhere else in the Town, he might have received more of an exchange from our chatty Board this night. This also highlights one of the serious campaign issues brought up by Mr Feiner’s challenger, Robert “Bob” Bernstein, that of a Town Board which is aloof, condescending and unresponsive to its engaged and experienced residents – no matter how many times they insist otherwise.

Back to our original assertion, which was about disrespectful way this Board regards the victims, families and friends of the September 11, 2001 attacks. Ceremonies that were happening throughout the Town in Villages were respectfully attended by many, a fact that is easily recognized given the lack of participation of the public this night. We’re sure there were others who decided not to attend because they were disappointed in the Democratic primary results, which is totally understandable. Yet this same Board will delay and cancel Town Board meetings on a whim. They will delay the start of these meetings when issues of substance requiring public hearings need more time than they will allow. They delay meeting after meeting to allow poetry recitals, musical performances, magic shows, and other illusional distractions. The Board will delay the meeting to present certificates of appreciation, watch movies made by kids and they will dress up in period costumes in a counterfeit attempt to entertain their detached cohorts. But why won’t they cancel a meeting to observe a national day of reflection? After all, Mr Feiner released one press release after another to announce the building of and the later renovation of our Town Memorial on Central Avenue. Why not do have a ceremony there?

It has been suggested on more than one occasion that this Town Board will cancel meetings during the summer months for several reasons. One is that there is less to do during the summer. Really? Does government stop during warmer months? Hardly. In fact, it appears there is more going on throughout the Town that should be addressed by our detached and elitist Town Board. But, the most recurring reason that always comes up is if there is a primary or an election that year, Mr Feiner and his Board will need a way to limit his or his Board members’ exposure and their opponents exposure. By canceling the Town Board meetings they’re assured to limit their opponents free exposure on the cable access/Verizon channels and aid their campaign. This year Mr Feiner needed to limit Mr Bernstein and Ms Brunson Fantauzzi’s exposure. It worked. Its amazing how the system is stacked against a challenger and for the incumbent.

Every move Mr Feiner makes has a personal motive. Sometimes, as in the WestHelp debacle where the Town has already lost $2.4 million and counting, it may take two or more years to see why he did what he did. Of course, deflection. He went against the Fortress Bible Church years ago to help protect the neighborhood of his buddy, Tom Abinanti, then a County Legislator and now State Assemblyman. He met with GameOn 365 approximately one year before the Town acquired the property at 715 Dobbs Ferry Road, the former Frank’s Nursery, secretly offering to gift it to them with an illegal lease and way below market value. He assisted Westhab with acquiring funds and then the property at 22 Tarrytown Road long before he informed the Fulton Park neighborhood that they were about to be assaulted again with low income, subsidized Section 8 housing. Studies have shown that crime follows Section 8 housing and Fulton Park is living proof of it. Ever since the building has begun occupancy, break-ins to cars and homes in the neighborhood has returned. “I’m going to prove to the resident’s of Fulton park how I feel about them. You’re going to change your opinion of me,” said Mr Feiner after doing nothing after Hurricane Irene wiped out so many residents. It was another lie from Mr Feiner. So, yes, they’ve changed their opinion of him.

So what can we do about a bereft Town Board interested in only their own agenda and not the peoples’  issues? Apparently, very little without a united Town. The Republicans have dismissed Greenburgh. According to the Greenburgh Republican Leader and the Westchester Republican Party leader, they will not waste their time and energy to fight a battle in Greenburgh. The Democratic leaders handily supported Mr Bernstein over Mr Feiner in their nominating meeting as the endorsed candidate. Does this mean Mr Feiner is bulletproof? Of course not. Looking at the numbers, Mr Feiner received 3,801 to Mr Bernsteins 2,121 votes out of the 42,000 registered democratic voters in Greenburgh! Just under 6k Democrats voted in another typically low-turnout primary event. This is hardly a justifiable representation when Mr Feiner only received 1,680 more votes than Mr Bernstein out of 42,000 possible votes.

We hope that next year, the showmen and women that sit on the Town Board will observe and celebrate the Second Day of Infamy with more than a simple, afterthought moment of silence. In spite of this indifference and insensitivity exhibited by the Town Board, we refuse to acquiesce. While we observe and respect those whose lives were lost on September 11, 2001, we can only hope our Town Board will do the same next year. In spite of them, ABG believes we can still have A Better Greenburgh.

Why No Decision?

With the WestHelp fiasco finally behind us after New York State’s representatives stated they would not endorse demolishing existing, albeit decaying, affordable housing, we continue to watch The Paul and his Board sit on their proverbial hands as the lessee of this facility. The Paul had requested proposals for the property some time back. ABG is convinced this was nothing more than his typical stall tactic while he waited for the circling wagons of support to make their final decision his way. Ever the shrewd politician, he began this debacle over two years ago when he hatched yet another lawsuit-worthy scheme!

If you follow ABG, we had been against what The Paul was doing with the WestHelp property all along. Others had been against him as well and we have all prevailed on the side on logic, common sense, societal decency, and by a rudimentary understanding of the contractual agreement the town maintained with the county! It was no surprise to many of us that this proposed WestHelp destruction for the benefit of the Ferncliff School of Yonkers would never materialize. Being proved right does not make us feel like the victor. ABG and others feel terrible that the Ferncliff School was duped and set back by The Paul’s maneuvering and manipulation of them. ABG has written about this sort of behavior from The Paul. It’s a shame that Ferncliff lost two valuable years in their search for a new location because of his lying and scheming!

But what of the property now? While this two-year long saga dragged on, the property was intentionally left abandoned by The Paul and the Town. Open to the elements, stripped of piping and appliances, vandalism, and animal destruction, it’s estimated to cost about $3M to renovate the facility before it can be used again. That’s about the same amount of money the Town could have made, not lost, had the Town simply secured the facility. The Greenburgh Housing Authority has people in need of housing which could have satisfied about half of their list of people had The Paul and his Board elected to simply put them in the facility once the County ceased to utilize it. Everybody lost by the Town not resigning the contract with the County, especially it’s own residents in need of a home. Its a shame the we continued to lose the $1.2M per year in rent by The Paul and not house people in need of existing affordable housing.

Again, what of the property now? The last Town Board work session had a few of the bidders for the property “re-present” their RFP, with one company increasing their cash offering by doubling it. Then, shortly thereafter, they withdrew from the bidding. ABG believes if The Paul and his Board operated in ernest, and did a legitimate RFP process each time there was Town involvement in a property for sale, we would see higher amounts offered. But there appears to be nothing but collusive actions every way we turn, so it’s difficult to know how successful the Town might actually be in a process of true “open government” was practiced.

There are two properties in the Town languishing under The Paul’s distorted view of what our Town needs. First is the obvious degradation and proposed ruining of the WestHelp facility for him to garner favor with County Executive Rob Astorino, County Legislator Michael Smith and County Communications Director Ned McCormack. Of course, the gain for The Paul is a recouping of lost Valhalla votes after having his illegal payments to the school board stopped in court! The second property is at 715 Dobbs Ferry Road. It’s the old Frank’s Nursery property that The Paul tried to illegal lease to GameOn 365 with another back room deal. There are numerous issues here as well but a much simpler solution from which several might be offered. The Town should do the site remediation that is required to make the property “whole” and then offer it for sale instead of trying to finagle a way to get someone else to pay for the cleanup. If The Paul’s concern for the Ferncliff School were genuine, he and the Board would sell the property to Ferncliff School and kill two birds with one stone. If not, ask for an RFP for the property instead of making another illegal back room deal for it. Assume the land, remediate it and make it another ball field/park within the Town. One of the two recreation commissioners (duplicate positions) said we need more fields for the Town. ABG believes this was a dishonest plea, sought and paid for by The Paul as an endorsement of the GameOn 365 deal he brokered prior to the Town acquiring the foreclosed upon property.

The Town had RFP’s submitted a month ago. Now The Paul is playing more games and re-interviewing the companies’ and their submissions. Why has no decision been rendered when they’ve had enough time to proceed? ABG doesn’t buy their constant reply of doing their due diligence. Their operational incompetence will not matter how much due diligence is done. Regardless of the lies, back room dealings and promises made, the Town has the ability to right this extremely wrong position - twice - and get the Town back on track. We can only hope.

Ferncliff Deal Rejected – Everyone Loses!

In a stunning, yet expected, upset, The Paul, the Town Board, County Executive Rob Astorino, County Legislator Michael Smith, CE Advisor Ned McCormack and a few lesser players, have failed with their bid to remove the WestHelp affordable housing from the Westchester Community College Campus – again! They fought it when it was proposed and even tried to secede from the Town and incorporate as a Village just to fight the Town’s acceptance of it! ABG will state that we honestly believe the Ferncliff School does great work, serves a vital community service and was most likely duped into believing The Paul with another of his convoluted schemes.

A letter posted below from the State, details the state’s rejection of Ferncliff’s request to proceed with the WestHelp project.

Over a year has gone by with The Paul-induced and Town Board supporting, the failure to live up to its contract with the County. You may recall the contract stipulated that the Town be paid $1.2M per year to house low/no income individuals and to maintain the facility. ABG believes The Paul ordered the facility to remain left abandoned and exposed to facilitate its rapid deterioration. ABG also believes there was a deal made between The Paul, Rob Astorino and Michael Smith for some return favor to be determined at a later date. Ultimately, ABG has maintained this has always been about The Paul acquiring votes in the next election. But The Paul’s intentional ruining of these apartments while the Greenburgh Housing Authority maintains a list of some 250 or so families in need of housing is the real  crime.

Only last week Legislator Catherine Borgia, D-Ossining said, “What happened between the end of the WestHELP lease and today? And why is Greenburgh still involved when provisions are not being met?” ABG wants to know why the all the county legislators weren’t demanding the answer to this same question for over a year? And, will the County be pursuing restitution for The Paul’s wrongdoings or are they going to let it just “disappear”? Could it be that everyone’s blind party affiliations and the partisan need to sit with one side or the other is more at play here than anything else? Were the democrats who favored the Ferncliff School deal simply representing their Yonkers-based constituents or trying to support The Paul – or both? Were the republicans siding with Astorino for similar partisan reasons? You decide.

In the end, nobody won. The Paul failed to buy his votes from Valhalla. Rob Astorino and Mike Smith haven’t endeared themselves any more or less with their neighbors but have proven they are still racist. The Ferncliff School loses because they are still no closer to relocating to a newer facility. The no/low income people and the Greenburgh Housing Authority’s families and individual members in need of housing are still in need of housing. The Town of Greenburgh loses to the tune of $1.2M each year (or $100K each month) because of The Paul’s corrupt and reprehensible decisions. The County loses because their facility was left vacant and forced to deteriorate and will require repairs to be utilized again.

Several RFP’s indicated that this $20M facility would require approximately $3M in renovations to make it habitable again. Let’s hope the County appropriates the necessary emergency funding to do these repairs immediately and get the housing back to it’s required condition for use. ABG doubts the County will decide to bring an action against the Town, as that may have been the deal made for The Paul’s participation in helping the Mayfair-Knollwood neighborhood. The Paul is no stranger to lawsuits against him. While the Town maintains a AAA Bond Rating it has never taken advantage of, the time for it’s unfortunate need is approaching. ABG doesn’t wish to see more lawsuits against the Town. What ABG would like to see is The Paul and his Board resign in an admission of their dereliction and illegal actions. We can only hope.

Pedestrian Struck on Knollwood Road

Sure, there’s a snowstorm happening as we post this and we expect accidents to happen. As we sit in our offices looking over the Town, our police scanner is busy with all the usual calls plus those created by the weather. Numerous police and fire departments along with ambulances have been scrambling about the County as well as the Town to accidents of various degrees of severity.

The Broadway Civic Association has long complained that the Town is shirking its responsibility by not insisting to install sidewalks in numerous places, but specifically leading to the newly built and just-opened Greenburgh Health Center on Knollwood Road. In fact, the Town Planning Board approved a sidewalk at 275 Knollwood Rd, the location of The Knolls at Pinewood, a 15-unit luxury condominium, of which 13 are complete. But ‘The Knolls’ doesn’t want sidewalks built – neither does The Paul! And, of course, since The Paul doesn’t want it, his Town Board doesn’t want them either.

Interestingly, when The Paul, his Town Board, County Executive Rob Astorino, his aide Ned McCormack and County Legislator Michael Smith were all pushing to destroy WestHelp for Valhalla votes, Kevin “Henchman” Morgan suggested the need to build sidewalks on Knollwood Road from WestHelp’s property toward Rt 119 because it would be unsafe for Ferncliff residents to walk on Knollwood Road without them. The irony is that the Ferncliff residents and day students would never be walking anywhere. They would have a van transporting them wherever they might be going. The Henchman must have misspoke.

The point? At about 2PM today, Friday, a pedestrian was struck by a car walking on Knollwood Road at the entrance to the Westchester Community College. There is no sidewalk. At the other end of Knollwood Road, the new Greenburgh Health Center has opened. It’s only a matter of time that a pedestrian gets hit by a car at this new address. The old Community Health Center on Rt 119 across from the former A&P in the Crossroads Shopping Center, found many of it’s clients crossing Rt 119 with kids, strollers and shopping bags, etc., in all kinds of weather and traffic. The dangerous situation that existed at one area has been shifted to another. Even though it is a different area, the same risk still exists for the health center’s clientele, just at their new home. There is no sidewalk.

The Paul had championed the illegal sale of the old Cooke’s Florist property to the Mount Vernon Medical Group that runs the medical center doing business as the Greenburgh Health Center. He spot-zoned the property and has trumpeted not installing sidewalks for this location. While we hope no one ever gets hurt coming or going to this new location, the amount of traffic that frequents the area almost guarantees it. Many will recall how The Paul continually bragged about the Town’s AAA Bond Rating some months ago. Perhaps if we utilized some of it by borrowing the necessary funds and building sidewalks throughout the busy streets in our Town, we can save people from being involved in an unnecessary accidents and injuries. We can only hope.

Assaulted From Every Level

The Paul decided a previously thought-to-be untouched neighborhood should have a group home for the developmentally disabled located in it at 88 North Road. He also decided to keep his goal from the neighborhood he was about to punish. Had he included the Parkway Homes neighborhood with his plan in the beginning, he would have learned there were other group homes in the immediate area. The Paul’s actions highlights why we need term limits. The Paul has been in office for so long now, he’s in his 21st year, he has forgotten that he is there to serve the public, not himself, his developer friends, the county or the state! And since the electorate cannot seem to stop reelecting career politicians after a few terms, mandatory exiting through term limits would keep the abuse from perpetuating.

So while The Paul “ghettoizes” Fairview (Alfreda Williams, January 14, 2013, WestHelp Forum in White Plains) with more and more not-for-profits, building homeless/affordable/low-no income/Section 8 and any other type of housing that will not pay taxes, the State has decided to implant it’s own housing in Greenburgh. Why aren’t our elected Greenburgh officials standing up for what our residents want? Did The Paul invite the State to purchase 88 North Road or did the owner of it seek them? Could the State merely have been stumbled upon it? Doubtful. ABG believes The Paul reached out to the State agency and “suggested” 88 North Road to them, promising they will sail right through the approvals/zoning changes, et al, once he makes his Board the project’s lead agency.

In another seemingly shady move, this time from Westchester County and CE Rob Astorino, the County has entered into a deal with a church in Mount Vernon, namely the Friendship Worship Center, on Lincoln Avenue to create a homeless shelter in their basement. The hours of operation for this “warming center” are 9PM until 6AM each day. There are four schools in the nearby vicinity. So once the homeless are asked to leave at 6AM, they will probably be running into teachers, students and their parents arriving at school. It seems we are being assaulted at every level of government with low income and homeless housing. We have the Federal HUD mandate, NY State building out of place group homes in residential neighborhoods, this “paying of churches” by the County, and The Paul saying we should tear down the 108 units in Valhalla that were built specifically for the homeless population. Why so much? Because everyone knows where the money is and simply needs to form a not-for-profit company to jump on the government gravy train.

The homeless problem has lessened a bit in Westchester County, although the frigid weather brings the reality of it right back to our doorstep. Legislator Lyndon Williams made several excellent points in his letter to the County Executive. Here’s an excerpt:

“Addressing the homeless problem is a County obligation that requires a comprehensive long- term, county-wide solution, not a patchwork of fixes in which the homeless population is targeted for tolerant communities like Mount Vernon. Moreover, many of the homeless persons are in need on mental health services, and yet your Administration has closed the County’s mental health clinics that provided such services to this vulnerable population.

Perhaps more than any other community in Westchester, Mount Vernon has done its part in cooperating with the County to address the problems of the poor and vulnerable. However, this City cannot continue to be the dumping ground for all of the social problems of Westchester County, especially when considering that your Administration has eliminated from the 2013 County Budget many of the worthwhile programs that benefit Mount Vernon, like funding for at- risk youth initiatives that have been proven to be quite successful.

I do not want to simply point to the problem without proposing a solution. Therefore, I suggest that the $120,000 awarded to Friendship Worship Center to house the homeless be used instead by the Church to run programs that serve at-risk youth in Mount Vernon.

The shelter program for the homeless, in turn, should be located in the county-owned housing located adjacent to the Westchester Community College campus in Valhalla. This facility consists of 108 units of housing that are presently available and unoccupied. The fully equipped facility, which was constructed under the administration of former County Executive Andrew O’Rourke, was intended to house the homeless and that intention should be fulfilled by using it to solve the homeless problem in Westchester County.

It is truly a disgrace that housing specifically constructed to address the problem of homelessness remains vacant while these most vulnerable members of our communities are left to wander the streets, sleep in doorways of buildings and even die in cars in which they reside by necessity. Mr. Astorino, you have an opportunity to change the plight of the homeless by implementing this solution.”

ABG agrees with Legislator Lyndon Williams and hopes the County Executive will heed his plea to not pay off his friends and cronies, use the County taxpayer money properly and reopen the WestHelp housing that sits hostage under The Paul. We can only hope.
